Creating a Communications Utility - Village of Hustisford

ORDINANCE CREATING A MUNICIPAL COMMUNICATIONS UTILITY

WHEREAS, the Village of Hustisford currently owns and operates electric, sewer and water utilities, and

WHEREAS, the Village Board finds that a municipal communications system would provide public benefits by providing for the continued growth and economic development of the Village of Hustisford and is, thereby, in the best interests of the Village of Hustisford, and

WHEREAS, the Village Board further finds that a municipal communications system is in the public interest as a means of facilitating the provision of telecommunications, data, fiber optic, Internet, cable television, video and information services to the Village of Hustisford, Village departments, the school district, and the public generally in and around the Hustisford area.

NOW, THEREFORE, the Village Board of the Village of Hustisford, Dodge County, Wisconsin, do ordain as follows:

SECTION I: CREATION OF COMMUNICATIONS UTILITY.

A. Pursuant to chapters 61 and 66 of the Wisconsin statutes and, without limitation, Wis. Stat. § 61.34(l), the village Board hereby exercises its authority to create a municipal communications utility within the village of Hustisford.

B. The communications utility shall be respqnsible to plan, acquire, construct, extend, improve, maintain, operate, lease, dispose of, regulate, and manage a communications system to provide, among other things, telecommunications, data, fiber optic, Internet, cable television, video and information services in and around the Hustisford area.

C. The communications utility shall be under the charge and management of the Hustisford utilities commission, which may exercise all powers necessary or desirable to effect its purposes.
