Prohibiting the Use of Compression (Jake) Brakes - City of Tomahawk

AN ORDINANCE CREATING SECTION 7.13 of the TRAFFIC CODE PROHIBITING THE USE OF COMPRESSION BRAKES

The Common Council of the City of Tomahawk ordains as follows:

Section 7.13 is created as follows:

7.13 COMPRESSION BRAKES PROHIBITED:

(a) Prohibition. No person shall use motor vehicle brakes within the City of Tomahawk which are in any way activated or operated by the compression of the engine of any motor vehicle or any unit or part thereof.

(b) Exception. It shall be an affirmative defense to prosecution under this subsection that said compression brakes were necessary for the protection of persons and/or property.

(c) Penalty. Any person violating the provision of this subsection shall upon conviction pay the forfeitures as provided for in Section 25.04 of the City of Tomahawk Municipal Code.

This ordinance shall become effective upon passage and publication.
