Alcohol Beverages - Premises to be Licensed - Oshkosh

A GENERAL ORDINANCE OF THE CITY OF OSHKOSH CREATING SECTION 4-5(A) OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO

ALCOHOL BEVERAGES - PREMISES TO BE LICENSED,

WHEREAS, the Common Council of the city of Oshkosh has previously established by resolution a tavern licensing policy allowing for the review of dormant licenses and for permitting maximum use of alcohol beverage licenses by those desiring to establish such businesses; and

WHEREAS, Chapter 125 of the Wisconsin Statutes establishes the requirements for revocation and suspension of licenses and

WHEREAS, Chapter 125 of the Wisconsin Statutes requires that municipal regulations which call for the suspension or revocation of alcohol beverage licenses must be adopted by ordinance.

The Common Council of the City of Oshkosh does ordain as follows:

SECTION 1. That Section 4-5(A) of the Oshkosh Municipal Code establishing the required use of an alcohol beverage license is hereby created to read as follows:

(A)Required use of License. Failure to complete the requirements for issuance of a "Class B" or Class "B" license though such license has been granted by the Common Council and/or failure to conduct a license-related business on a premises for which a license shall be issued for any consecutive two year period shall be a violation of this chapter punishable by revocation of the license only.

SECTION 2. This ordinance shall be in full force and effect from, and after its passage and publication.
