Burning Regulations - Wales

SECTION L: Section 10.12 entitled "Penalty" of the Village Code of the ViIlage of Wales is hereby renumbered to read as follows:

10.25 PENALTY. . .

SECTION 2; Section 10.12 of the Village Code of the Village of Wales is hereby created to read as follows;

10.12 BURNING REGULATIONS

(1) RESIDENTIAL BURNING. No burning permit shall be required for burning of materials on properties zoned or used for residential purposes, provided, however, that every fire must be attended at all times with sufficient fire fighting equipment including rakes, shovels, hose connections and similar materials so as to allow the property owner to control the fire at all tines.

(2) COMMERCIAL, BUSINESS, AND OTHER BURNINGS PROHIBITED. All burning on any commercial, business, or other property within the Village, except for residential, is hereby prohibited,

(3) COSTS OF FIRE RUN. Any person, business, corporation, or organization which violates the terms of this section, or burns in a manner which results in a fire run from any fire department, shall, in addition to the penalties provided herein, be liable to the Village for the current charge for a fire run by the Wales Fire Department.

(4) PENALTIES. Any person violating this ordinance shall be subject to a forfeiture of Fifty Dollars ($50.00), plus statutory costs, for the first offense, Two Hundred Fifty Dollars ($250.00), plus statutory costs, for the second offense occurring within a twelve (12) month period of time.

SECTION 3: All ordinances or parts of ordinances conflicting with or contravening the provisions of this ordinance are hereby repealed,

SECTION 4: This ordinance shall take effect upon passage and posting as provided by law.
