Banners - Waterford

The Village Board of the Village of Waterford, Racine County, Wisconsin, do ordain as follows

Chapter 14 of the Municipal Code, of the Village of Waterford, Racine County, Wisconsin, is hereby amended such that Section 14.04, is amended as follows, to wit:

1. Section 14.04(2), Definitions. There shall be added to this sub-section the following definition, to wit:

Banners: All signage, comprised primarily of cloth, canvas, plastic, or other similar flexible material, upon which is placed advertising content, and which is affixed by any means to the exterior of any other structure or support upon any private property in the Village. Flags are specifically excluded from this definition.

2. Section 14.04(3), Permits. 14.04(3)(a)(3)(i) is hereby amended to read as follows, to wit:

14.04(3)(a)(3)(i) Banner Limitations. The display of banners in the Village of Waterford, upon private property, shall be limited to the following specified uses and under the following set of controls and conditions:

(1) Banners displayed shall be secured at every corner.

(2) Banners shall be affixed to buildings only, shall not be affixed to other sign supports, nor any other permanent or temporary fixture upon real property. Banners advertising special events, conducted by "not for profit" organizations, may be exempted from the requirements of this sub-section upon application to the Village of Waterford Plan Commission.

There shall be not more shall Two (2) banners displayed at any time upon any parcel of real property in tile Village of Waterford, and the square footage of all banners so displayed upon any parcel of real estate in the Village of Waterford shall not. in total, exceed 32 square feet.

(4) Banners shall be displayed in a manner so as to not cover nor obscure address markers or other signage upon the building to which the same is affixed.

(5) Every banner displayed shall be dated with indelible marker indicating the first day of display in the current usage period. No banner shall be displayed longer than Forty-two (42) days in a usage period. The display of any banner upon the same real estate parcel shall not occur until the passage of Forty-five (45) days from the last day of any previous banner display.

(6) Prior to the display of any banner, a permit form shall be completed and filed with the Village Clerk, in a format as provided by said clerk, indicating the name and address of the applicant, the address and location of the display, the nature of the banner content, and the first day of display. There shall be no banner permit fee.

(7) Banners which are torn, or are otherwise in disrepair, are prohibited.

(8) Violations of 14.04(3)(a)(3)(i) shall be punishable by fine of $20.00 plus court costs. Each day a violation exists shall constitute a separate offense.

It is further ordained that this ordinance shall become effective from and after its passage and publication as required by law.

All other language as contained in Section 14.04 of the Municipal Code of the Village of Waterford shall remain without change and in full force and effect.

4. Banners shall be displayed in a manner so as to not cover nor obscure address markers or other signage upon the building to which the banner is affixed.

5. Every banner displayed shall be dated with indelible marker indicating the first day of display in the current usage period.

No banner shall be displayed longer than Forty-two (42) days in a usage period. The display of any banner upon the same real estate parcel shall not occur until the passage of Forty-five (45) days from the last day of any pervious banner display.

6. Prior to the display of any banner, a permit form must be completed and filed with the Village Clerk.

7. Banners which are torn, or are otherwise in disrepair, are prohibited.

8. Violations of the Banner Ordinance is punishable by fine of $20.00 plus court costs for each day the banner is in violation.
