VILLAGE OF EGG HARBOR, WISCONSIN

GENERAL ORDINANCE NO, 201 AN ORDINANCE REVISING AND RESTRUCTURING VILLAGE COMMITTEES, BOARDS, AND COMMISSIONS.

SECTION I. That the organization, structure and function of the Committees, Boards and Commissions of the Village of Egg Harbor be, and the same hereby are, modified, revised and restructured in the manner provided in Exhibit "A", attached and annexed hereto and incorporated herein.

SECTION II. That all Ordinances, or parts of Ordinances, in conflict herewith are hereby repealed.

SECTION III. That this Ordinance shall take effect immediately upon passage and publication of the same in the manner made and provided by law.

Exhibit A

SECTION I: BOARDS & COMMISSIONS

(1) BOARD OF APPEALS. The composition and functions of the Board of Appeals shall be in accordance-with Section 62.23 (7) (e), Wis. Stats., and Sect. 8 of the Village Zoning Ordinance.

(2) BOARD OF REVIEW.

(a) Composition.

1. The Board of Review shall consist of the Village Board of Trustees.

2. In addition to the five members, the Village Clerk Treasurer shall serve as a non-voting member of the Board.

3. The Village Assessor shall attend all meetings of the Board of Review.

4. No Board of Review may be constituted unless it includes at least one voting member who, within two (2) years of the Board's first meeting, has attended a training session under see. 73.03 (54) Wis. Stats., and unless that member is the municipality's chief executive officer or that officer's designee. The Village Clerk shall provide an affidavit to the Department of Revenue stating whether the requirement has been fulfilled.

(b) Functions. The duties and functions of the Board of Review shall be in accordance with Section 70-47, Wis. Stats. Reference: Sections 70.46 and 70.47, Wis. Stats.

(3)ELECTION OFFICIALS. The composition and functions of the Election Officials shall be in accordance with Section 7, Wis. Stats., and Village Ordinance No. 10 and No. 54.

(4) PLAN COMMISSION. The composition and functions of the Plan Commission shall be in accordance with. Section 62.23, Wis. Stats., and Village Ordinance No.33 and No. 137.

SECTION II: COMMITTEE COMPOSITION & ORGANIZATION

(1) Committee members and the chairperson thereof, shall, except as stated herein, be appointed by the Village President, subject to approval by the Village Board, at the Annual Organizational Meeting.

(2) Composition of Committees. Each committee shall consist of at least three members. Bach member shall serve as appointed unless excused by a majority of the Village Board. All trustees shall serve on at least one standing committee. Appointments thereto shall be by a majority vote of all members of the Board. The President, if not a standing member, may serve as an alternate member of each committee and may serve in the absence or disqualification of any committee member whose absence results in the lack of a quorum.

(3) Ad Hoc Committees, The Village President may, from time to time, appoint a temporary Ad Hoc study committee for such special purposes as the President may determine. Such committee shall be as provided for by resolution which shall state the composition and the committee function.

(4) Terms, Except as stated herein, terms of appointment shall be staggered three (3) year terms.

(5) Rules of Order. The Chairperson, at the stated time, shall call the meeting to order, shall preserve order and decorum, decide all questions of order and conduct the proceedings of the meeting in accordance with parliamentary rules, unless otherwise provided by statute or by the rules stated herein.

(6) Organization. The Chairperson shall appoint a secretary to record minutes of the committee meeting. Each committee should elect a Vice-Chairperson.

(a) Quorum. A majority of committee membership shall constitute a quorum for the transaction of business. No motion can be made nor action taken if a quorum is not met.

(b) Agenda. The Chairperson is responsible for the preparation of an agenda and shall provide a copy of such agenda to the Village Clerk Treasurer for posting and distribution to other committee members and affected persons at least forty-eight (48) hours prior to such meeting. Informational material for items identified on the agenda shall also be provided with the agenda.

(c) Attendance. If for some reason a member is unable to attend a committee meeting, it is the committee member's responsibility to inform the Chairperson. Three consecutive absences by a member of any committee from regularly scheduled meetings shah operate to vacate the member's office. An absence excused by the Chairperson for good cause shall not be considered an absence herein.

(7) Committee Action. Unless otherwise stated herein, all committees are advisory in their capacity and make recommendations on desired actions to the Village Board.

(8) Submittal of Minutes. All committee chairpersons shall submit a copy of their meeting minutes to the Village Clerk Treasurer. If action by the Village Board is desired, such action shall be so denoted, by motion, in the minutes, and shall be submitted no later than the first Wednesday of the month such action is desired.

SECTION III: COMMITTEES

(1) BUILDINGS AND GROUNDS COMMITTEE.

(a) Composition:

1. The Buildings and Grounds Committee shall consist of one Village Board member, who shall be its Chairperson, and no less than four (4) citizen members, appointed by the Village President subject to confirmation of the Village Board. The citizen members shall serve for terms of three (3) years, except that of those first appointed one shall serve for one (1) year, one for two (2) years and two for three (3) years. Citizen members shall, if practicable, be persons knowledgeable or experienced in one or more of the following or related fields: Parks and recreation; landscaping, urban forestry; civil engineering, urban or rural planning; architecture; natural environment; natural art; construction; or real estate. Citizen membership should be as diverse as practicable. One member shall be a member of the Egg Harbor Business Association, if practicable.

2. In addition to the citizen members, the Zoning Administrator shall serve as a non-voting member of the Committee.

(b) Functions.

1. The committee shall meet quarterly or as needed to:

a. Update the 5-Year Capital 1mprovement Plan for all public grounds, and for all public buildings except the Waste Water Treatment Plant buildings.

b. Update the 5-Year Outdoor Recreation Plan.

c. Develop and recommend an annual budget for the buildings and grounds.

d. Recommend locations for connecting pathways.

e. Develop plans and make recommendations for: the acquisition of land for park and recreation purposes; the construction or addition of facilities designed to improve the parks, street terraces, park facilities, public grounds and public pathways; street beautification projects such as

ornamental streetlights, terrace streetscapes, and similar amenities; and for seasonal festivity banners and decorations.

f. Make recommendations on landscaping and grounds keeping for all public grounds.

g. Recommend fees and rules for room rental at the Community Center

h. Considering suggestions from the Librarian, make recommendations for the physical needs and the operation of the library.

(2) EXECUTIVE COMMITTEE:

(a) Composition.

1. The Executive Committee shall consist of the Village President, who shall be its Chairperson, and two (2) Village Board members appointed by the Village President subject to confirmation of the Village Board. in addition, the Village Administrator shall serve as a non-voting member of the committee for personnel matters, unless excused, and the Village Administrator and the Village Clerk Treasurer shall serve as non-voting members of the committee for financial matters.

(b) Functions.

1. Finance.

a. The Executive Committee shall meet as needed to discuss and make recommendations on the following or similar matters: Village or Utility financing for capital improvements, capital projects, and capital equipment financing or leasing; refinancing; bond proceeds investing; financial forecasting; financing for housing development, economic development, or for tax incremental financing; and bond counsel for financing, refinancing, financial evaluation, or bond rating,

b. Each year at the Annual Organizational Meeting, one voting member of the Executive Committee shall be assigned the task to review the monthly vouchers for Village Board action.

2. Personnel. The Executive Committee shall meet as needed for the following or similar matters:

a. Advise the Board on matters concerning administrative implementation of personnel policy.

b. Review proposed personnel policies and amendments as developed by the Village Administrator and make recommendations to the Board for consideration and legislative action.

c. Approve or reject new positions as recommended by the Village Administrator.

d. Approve or reject the elimination of positions.

e. Conduct an annual performance evaluation of the Administrator and make recommendations to the Board.

f. Annually review and recommend to the Board a Wary plan and compensation program for the Village Administrator.

g. Serve as the recruitment authority for the Village Administrator position.

h. Perform other related duties as assigned by the Board.

(3) HARBOR COMMITTEE

(a) Composition.

1. The Harbor Committee shall consist of one Village Board member, who shall be its Chairperson, and four (4) citizens, appointed by the Village President subject to confirmation of the Village Board. The citizen members shall serve for terms of three (3) years, except that of those first appointed one shall serve for one (1) year, one for two (2) years and two for three (3) years. Citizen members shall be persons knowledgeable in the functions and management of the harbor facilities.

2. In addition to the citizen members, the Village Administrator and the Harbormaster shall serve as non-voting members of the Committee.

(b) Functions. The Committee shall meet as needed to update the 5-Year Harbor Plan, to refine harbor development plans, and to recommend additions or changes to the harbor facilities.- The Committee shall discuss issues of safety, function, maintenance needs, policy, and events. The Committee shall plan for the effectuation of harbor improvements and make such plans as it deems necessary and essential for the improvement of the harbor, and to adequately provide for the needs of harbor patrons, Village residents, and tourists. Among other things, such plans may include recommendations for the acquisition of land for harbor purposes and for the construction of harbor facilities designed to enlarge or improve the harbor facilities. The Committee shall annually, recommend fee changes, harbor ordinance amendments, and use of excess harbor revenues as put of the budgetary process.

(4) UTILITY COMMITTEE.

(a) Composition.

1. The Utility Committee shall consist of one Village Board member, who shall be its Chairperson, and four (4) citizens, appointed by the Village President subject to confirmation of the Village Board. The citizen members shall serve for terms of three (3) years, except that of those first appointed one shall serve for one (1) year, one for two (2) years and two for three (3) years. Citizen members shall be persons knowledgeable or experienced in the functions and management of the Waste Water Treatment Plant facilities or in civil engineering, if practicable.

2. In addition to the citizen members, the Village Administrator and the Waste Water Treatment Plant Manager shall serve as non-voting members of the Committee.

(b) Functions. The Committee shall meet as needed to update the 5-Year Capital Improvement Plan for the Waste Water Treatment Plant and its related infrastructure, to recommend utility ordinance amendments, to refine development plans, and to review and make recommendations on proposed improvements, additions, extensions, or changes to the facilities. The Committee shall discuss issues of safety, function, maintenance needs, and policy. The Committee shall plan for the effectuation of plant and infrastructure improvements and make such plans as it deems necessary and essential for the improvement of the plant. Among other things, such plans may include recommendations for the acquisition of land for plant related purposes and for the construction of facilities designed to enlarge or improve the plant. The Committee shall annually, recommend rate changes as part of the budgetary process.
