Water Supply for Fire Fighting - Eagle River

The Common Council of the City of Eagle River does hereby ordain as follows:

It is the intent of this ordinance to ensure an adequate water supply for fire fighting purposes to structures and buildings located at distances which are extended from the City water hydrants on private property.

1. Scope. This ordinance shall apply to all mercantile, industrial, institutional or multiple family buildings as follows:

(1) Fire resistive buildings if:

a. Over 10,000 square feet in area

b. Over one story in height and exceeding 6,000 square feet in area; or

c. Over four stories in height.

(2) Non-fire resistive buildings if:

a. Over 8,000 square feet in area;

b. Over one story in height and exceeding 5,000 square feet in area; or

c. Over three stories in height.

"Area" means the ground floor of a building.

2. Placement.

(a) The owner of any building to be erected or structurally altered to increase the floor area by 50 percent or more shall provide, at the owner's expense, an approved water hydrant when such building is set back 250 feet or more from any street or highway or is located more than 300 feet from a city water hydrant. Required hydrants shall be freestanding and shall be located not more than 50 feet or less than 25 feet from the main entrance to such building.

(b) An "approved water hydrant" means a water hydrant connected to a city water main with one 4Y2inch and two 2Y2inch fire department connections. The connecting water line between the city water main and the approved water hydrant shall be not less than eight inches. (Where the city water main is eight inches or larger, the connecting line shall be not less than eight inches in size.) All fire hydrants shall be approved by the fire chief and city water utility and shall be installed in compliance with the standards of the city water utility. All water hydrants shall be installed in such a manner and location so as to be accessible at all times by the fire department.

3. It shall be a requirement that anyone applying for a building permit in the City of Eagle River shall indicate in its permit application whether or not this ordinance is applicable to the applicant and if so, how the applicant intends to comply with this ordinance prior to the issuance of a building permit.

4. This ordinance may be enforced by the issuance of a citation as provided for elsewhere in the Code of Ordinances of the City of Eagle River or by the seeking of an injunction by the City of Eagle River to prevent any construction until compliance with this ordinance shall occur.
