Sign Ordinance - Village of Waunakee

AN ORDINANCE TO AMEND SECTIONS 106-957,106-959,106-960,106-96 1, and 106-965 OF THE WAUNAKEE CODE OF ORDINANCES, RELATING TO SIGNS AND BILLBOARDS

The Village Board of the Village of Waunakee, Dane County, Wisconsin, do ordain as follows:

1. Section 106-957, (Definitions) of the Code of Ordinances ("Code") is hereby amended so as to create new subsection (14), amend subsection (20), and renumber existing subsections (14) through (21) to become (15) through (22), as follows:

(14) Political sign. Any sign containing a message intended for a political purpose or a message which pertains to an issue of public policy of possible concern to the electorate, but does not include a message intended solely for a commercial purpose.

(15) Portable sign. Any sign not permanently attached to the ground that is designed to be easily moved from one location to another.

(16) Projecting sign. Any sign extending more than 18 inches, but less than five feet, from the face of a wall or building.

(17) Real estate sign. Any sign that is used to offer for sale, lease, or rent the property upon which the sign is placed.

(18) Roof sign. Any sign erected upon or over the roof or parapet of any building.

(19) Sign. Includes anything that promotes, calls attention to or invites patronage, or anything similar, to a business, location, or product.

(20) Temporary sign. Any sign intended to be displayed for a short period of time, including real estate or construction site signs, and banners, decorative-type displays, or anything similar to such, but not including political signs.

(2 1) Wall sign. Any sign attached to, erected on, or painted on the wall of a building or structure and projecting not more than 18 inches from such wall.

(22) Window sign. Any sign located completely within an enclosed building and visible from a public way.

2. The introductory paragraph of Section 106-959 of the Code is hereby amended to read as follows:

All signs must have a building permit, except the following, provided that the following exempt signs may not be located over a public road right-of-way or in, on, or over public water, and may not be located on Village property without prior Village plan commission approval:

3. Subsection 106-959(7) of the Code is amended to read as follows:

(7) Temporary signs not exceeding eleven (11) square feet in area, when authorized by the building inspector, for a period not to exceed 30 days.

4. Subsection 106-959(16) of the Code is created to read as follows:

(16) Political signs not exceeding eleven (11) square feet in area and not having an electrical, mechanical or audio component, during an election campaign period as provided in section 12.04, Wis. Stats.

5. Subsection 106-960(b)(7) of the Code is amended to read as follows:

(7) Temporary signs or banners not to exceed eleven (11) square feet, and in conformity with section 106-965.

6. Subsection 106-960(b)(8) of the Code is created to read as follows:

(8) Political signs not exceeding eleven (11) square feet in area and not having an electrical, mechanical or audio component during an election campaign period as defined in section 12.04, Wis. Stats.

7. Subsection 106-960 (c)(8) of the Code is amended to read as follows:

(8) Temporary signs or banners not exceeding eleven (11) square feet in area, and in conformity with section 106-965.

8. Subsection 106-960(c)(9) of the Code is created to read as follows:

(9) Political signs not exceeding eleven (11) square feet in area and not having an electrical, mechanical or audio component, during an election campaign period as provided in section 12.04, Wis. Stats.

9. Subsection 106-961(b) of the Code is amended to read as follows:

(b) Traffic interferencelsafety hazard. Signs shall not resemble, imitate, or approximate the shape, size, form, or color of railroad or traffic signs or devices. Signs shall not obstruct or interfere with the effectiveness of railroad or traffic signs, signals, or devices or the safe flow of traffic. No sign shall be erected, relocated, or maintained so as to prevent free ingress to or egress from any door, window, or fire escape. No sign shall be placed so as to obstruct or interfere with traffic visibility. The Village may remove any sign located on Village property without approval, or any sign which poses a traffic hazard emergency or other emergency threat to public safety as determined by the police chief or building inspector.

10. Subsection 106-965(1)a. of the Code is amended to read as follows:

(1) Temporary sign limitations.

a. All temporary signs such as real estate and construction site signs may be erected for 30 days and shall be removed within ten days after their use has discontinued.

11. Subsection 106-965(3)b. of the Code is amended to read as follows:

(3) Portable signs.

b. The maximum size of a portable sign in commercial and industrial districts shall be 25 square feet, and 11 square feet in residential, conservancy, agricultural and multiple family districts, on each face, back to back.
