AN ORDINANCE REPEALING AND RECREATING WAUWATOSA CODE CHAPTER 7.58 REGARDING SCHOOL TRUANCY

The Common Council of the City of Wauwatosa do ordain as follows:

Part 1. Chapter 7.58 is hereby repealed in its entirety and recreated to read as follows:

7.58.150 Mandatory Court Appearance

7.58.010 Definitions. A. "Drop out" has the meaning given in Section 118.153(l)(b) of the Wisconsin Statutes. B. "Habitual Truant" has the meaning given in Section 118.16(l)(a) of the Wisconsin Statutes.

7.58.020 Habitual Truancy Prohibited: Dispositions. A. It shall be unlawful for any person under 18 years of age to be a habitual truant. B. Violations of paragraph A shall be subject to one or more of the dispositions set forth in Section 118.163(2) of the Wisconsin Statutes.

7.58.080 Suspension of Operating Privileges of Drop Outs. The Municipal Court may suspend the operating privilege of a person who is at least 16 years of age but less than 18 years of age and is a drop out. Such suspension shall be in effect until the person reaches the age of 18.

7.58. 100 Contributing to Truancy. A- Except as provided in paragraph B of this section, any person 18 years of age or older, who by any act or omission knowingly encourages or contributes to the truancy of a child is in violation of this chapter and shall be subject to the general penalty provisions of the Code. B. Paragraph A of this section does not apply to a person who has under his or her control a child who has been sanctioned under Section 49.50(7)(h) of the Wisconsin Statutes.

7.58.150 Mandatory Court Appearance. Any person cited for a violation under this chapter shall be required to appear in Municipal Court.

Part II. This ordinance shall become effective on and after its date of publication.
