AN ORDINANCE AMENDING SECTIONS 17.02 (2) AND 17.04 (6), 17.08 (3), 17.09 (3) (h) and (c) AND REPEALING AND RECREATING SECTION 17.08 (1) (c) OF THE MUNICIPAL CODE RELATING TO GARAGE HEIGHT AND ANIENDING SECTION 17.11 (1) (b) OF THE MUNICIPAL CODE RELATING TO PERMMITTED USES IN A C-1 GENIERAL COMMERCIAL DISTRICT

THE VILLAGE BOARD OF THE VILLAGE OF RANDOPNI LAKE, SHEBOYGAN COUNTY, WISCONSIN, ORDAINS AS FOLLOWS:

Section 1. Section 17.02(2) of the Municipal Code is amended as follows:

(2) ACCESSORY BUILDINGS. A building or portion of a building subordinate to the main building and used for a purpose customarily incidental to the permitted use of the main building or the use of the premises.

Section 2. Section 17.04 (c) of the Municipal Code is amended follows:

(c) ACCESSORY BUILDINGS. Accessory buildings which are not a part of the main building shall not occupy more than 30% of the area of the required rear yard and shall not be nearer than 5 feet to any lot line nor 5 feet alley line and shall not into a front yard beyond the required setback.

Section 3. Section 17.08 (1) (c) of the Municipal Code is repealed and recreated as follows:

(c) 1. Attached Garages. Attached garages 1000 square feet in area maximum. Attached garages with living quarters above shall have a floor to ceiling height of ten feet maximum; attached garages without living quarters above shall have a floor to ceiling height of no more than ten feet maximum and a roof pitch no greater than that of the principal building living quarters.

2. Detached Garages. Detached garages 1000 square feet in area maximum, a floor to ceiling height of ten feet maximum, and a roof pitch no greater than that of the principal building.

Section 4. Section 17.08(3) of the municipal Code is amended as follows:

Building height:

Garages: see subsection (1)(c) above.
Garden and yard equipment shed: Maximum 15 feet.

Section 5. Section 17.09(3)(b) and (c) of the Municipal Code is amended as follows:

(b) Building height:

Garages: see Section 17.08(1)(c) above.
Garden and yard equipment shed: Maximum 15 feet.

(c) Building height:

Garages: see subsection (1)(c) above.
Garden and yard equipment shed; Maximum 15 feet.

Section 6. Section 17.11(1)(b) of the municipal code is amended as follows:

(b) General business and commercial uses which do not generate noise, smoke or odors that would create a public or private nuisance. These uses generally include the following:

Banks, commercial or professional offices and telephone offices.
Hotels and motels.
Places of amusement and theaters.
Personal service, automobile service, and equipment service establishments.
Bus depots.
Parking lots.
Licensed day care centers.
Existing one- and two-family dwellings.
Uses customarily incident to any of the above uses.

Section 7. This ordinance shall become effective upon passage and publication as required by law.
