What happens if an incumbent does
not file a Certificate of Noncandidacy and then fails to file
nomination papers? Is there a penalty? Can the person still run as a
write-in candidate?
If an incumbent does not file a
Certificate of Noncandidacy and fails to file nomination papers, the
deadline for filing nomination papers for that office is automatically
extended an additional seventy-two hours. However, the incumbent does
not get the benefit of the deadline extension. Wis. Stat. sec.
8.10(2)(a).There is no additional penalty. The incumbent can still run
as a write-in candidate, but must comply with all other requirements
relating to candidates.
